Anent the petition given in to the Lords of his Majesties privie Councill By Mr Charles Falconer Chirurgeon Sheuing That ther Having been a proclamation emitted against Captain Evories accomplices Their Lordships (upon production of a Certificat from Captain Evory the Commander Bearing that the petitioner was Carryed auay and detained by force all the tyme he uas aboard) were Graciously pleased in September Last to discharge the effect of the said proclamation against the petitioner upon finding bale to appear before their Lordships when called And Recommended to the Earle of Tullibardin then present to Interpose uith the English secretaries and Commissioners for the Admiralty for the petitioners exoneration And since that tyme In the tryall before the Admiralty of England some of the witnesses Did depone that he uas detained by force All which being represented to his Majesties privie Counsell of England by a petition and Lykewise by the Lord Cheiff Justice Holt who was one of the Judges at the tryall and then present at the Counsell board His Majestie was Graciously pleased to order the English Secretaries Grant the petitioner a passport from Scotland to England which was produced uith the said petitione granted by secretary Turnbull And therfore Humblie Craving to the effect underwryten as the said petition Bears The saids Lords of his Majesties privie Councill Having Considered this petition given in to them by the said Mr Charles Falconer uith the Councills Act Discharging the effect of the said proclamation against the petitioner upon his finding Cautione as before mentioned Togither uith secretary Turnbulls passport in his favoures They heirby Give order and warrand to their Clerks to delyver up the bond granted by the said petitioner and his Cautioner dated the third of September last And Recommends to the Earle of Tullibardin and Sir James Ogilvie of that ilk principall secretaries of state to Interpose uith the English Secretaries and Commissioners of the admiralty for the petitioners exoneration.
