Anent the petition given in to the Lords of his Majesties privie Councill By James Douglas prisoner in the tolbooth of Edinburgh Sheuing That wher the petitioner being arreasted at the Lord Advocats instance within the said tolbooth upon the third day of Agust Last And having applied to their Lordships upon thir tearms That he should not have any advyce from his Correspondent nor receave any Letters from him any more The saids Lords did then refeir the petitioner to the Lord Advocat to wryte to Sir James Ogilvie his Majesties Secretary (who examined him on the sixth of Agust Last) and to receave ansuer and report to their Lordships And againe upon the threttie one day of december Last the petitioner applyed to their Lordships Judging the Lord Advocat might have receaved returne from his Majesties secretary in such a tyme And the Lord Advocat not having receaved returne at that tyme Their Lordships remitted to the Advocat as formerly And seeing it being so long since (especiallie to a Starving prisoner) And being hopefull that his Lordship hath now receaved returne from the Lord secretary Anent the petitioner who through his Long Imprisonment is redacted to such extream povertie that he has not the Credite of ane barrell of ale yea and not only that but his Landlord uith the Land Stent and other publick burdens his house is displenished so that by uant of trade and other Inconveniences that is fallen upon him he is not in a Condition to maintaine himself and poor Numerous family and will undoubtedly be ruined unles their Lordships provyde some speedy remeddie And ordaine the petitioner to be free of all house dues and servants Fees of the said tolbooth which he is altogither unable to pay And therfore Humblie Craving their Lordships In Consideration of the premisses to Commiserat the sad and Calamitous Condition of the petitioners and family And to ordaine his Liberation free of house dues and servants fees of the tolbooth since their Lordships order he has not nor shall not Correspond uith his former Correspondent as the said petition Bears The saids Lords of his Majesties privie Councill Having Considered this petition given in to them by the said James Douglas They heirby Give order and warrand to the Magistrats of Edinburgh and Keeper of their tolbooth to sett the petitioner at Libertie furth therof In so far as he is Incarcerat by the saids Lords of privie Councill But prejudice to detaine him for any debt or Civill accompt for which he uas Imprisoned before he uas arreasted by the saids Lords of privy Councill.
