Act Viscount of Tarbats Exoneration
Anent the petitione given in to the Lords of his Majesties privie Councill By George Viscount of Tarbat Sheuing That wher the petitioner hath dimitted the office of Clerk of his Majesties Councill Registers and Rolls and that the Earle of Selkirk is Commissionat in the said office And during the petitioners absence his underkeeper of the records was ordered to delyver up the records to Mr James Hamilton Now underkeeper of the same And accordingly the same was done upon oath by John Ross of Newk the former underkeeper so as yet the petitioner is not exonered nor his oath taken In order therto as hath been aluayes Customary in such caices And therfore Humblie Craving their Lordships to appoint such of their oune Number as they shall Judge fitt to take the petitioners oath in ordinary forme that his exoneration may be theron expede and recorded as the said petition bears Which petitione Being upon the fifth day of May Jaj vic nyntie six years read in presence of the saids Lords They Recommended to a Committie of their oune Number to take the oath and deposition of the said Viscount of Tarbat in the above matter in the ordinary Forme Which Committie Having accordingly mett Compeared The said Lord Viscount of Tarbatt in their presence And being solemnly suorne and Interrogat upon his Great Oath Depones That he hes not directly nor Indirectly by himself nor by any other abstracted auay taken uithdrauen vitiat nor Imbazled any of the Records or uarrands delyvered to him or that were in the Register house below the parliament house or in the Castle of Edinburgh when the keyes therof uere delyvered to him at his entery to the office of Clerk Register In anno Jaj vic Eightie one nor in any office or Chamber belonging therto And that Insofarr as he knoues all the uarrands and records then delyvered to his Lordship or that have been since putt into the Clerke registers Custody in the forsaid house or or2 any other else are now uithin the same nor uas ther aither record or warrand taken out by his Lordship or by any to his knouledge which are not again putt into the saids houses And this is the truth as he shall Ansuer to God as the Viscounts oath subscryved by him and the Lords of the said Committie att Length proports And The saids Lords of his Majesties privie Councill Having this day Considered the said petition And the Lord Viscount of Tarbat’s depositione theron They heirby Exoner the said Lord Viscount of Tarbat of the said office of Clerk of his Majesties Councills Registers and rolls And discharges him of the records warrands and wrytes relating to the said office And of the Charge and trust which his Lordship had in Keeping of the same And Declares him free therof And of all that may be Laid to his Lordships charge theranent in any tyme Coming.
