Proclamation anent the deficients of the Levys 1693 and 1695

William By the Grace of God King of Great Britaine France and Ireland defender of the faith To […] Macers of our privie Councill Messengers at arms our shirreffs in that part Conjunctly and Severally speciallie Constitut Greeting Forasmuch as by the seventh Act of the fourth session of our Current parliament Ther was ane offer made to us of tuo thousand nyne hundred seventy nyne foot to be Levied off the severall burghs and shires of the Kingdome effeirand to the proportiones and Numbers sett doun in the forsaid Act Lyke as by the threttie third Act of the fifth session of the same parliament It is statut and ordained that ther should be furnished to us the number of one thousand men yearly when we should require them In manner mentioned in the said Act off which tuo Levies for the said year Jaj vic nyntie three as also the said year Jaj vic nyntie five There are notuithstanding of the severall proclamations Emitted by us In prosecutione of the saids Acts a Considerable number of deficient men yet resting unfurnished And it being requisite and necessary at this tyme that the saids deficients should be putt furth and furnished by the heretors and others lyable to putt furth the same uith all expedition Therfore ue uith advice of the Lords of our privie Councill Have thought fitt to ordaine And doe heirby peremptorly require and ordaine the Commissioners of Supplies of the severall Shires Steuartries and burghs uithin this Kingdome to meet at their respective head burghs These upon this Syde of Tay upon the Eleventh day of March nixt to Come And these on the other syde and all the rest of the Kingdome upon the tuenty third day of the said month of March with Certification to such of them as shall not meet that they shall be Lyable each of them to the penalties Contained in the Acts of parliament made Anent the militia And they being mett that they Consider and Inquire dilligently how the orders formerly Given by them for the outreick of the saids Levys have been observed And for that effect they require the heretors Leaders of the forsaid first Levy Jaj vic nyntie three As also the particular Commissioners or Heretors appointed for the outreick of the said Levy Jaj vic nyntie five as they shall see Cause aither to produce a sufficient discharge or document that they have putt furth and outrecked the Men one or more falling to their share or at Least that they have observed the order of Lotting appointed by the forsaid Act of parliament Jaj vic nyntie five with ane Account of the names and designations of the persones one or more upon whom the Lotts fall And whither these persones were delyvered or given up as deserters or otheruayes that the saids respective heretors Leaders and particular Commissioners who Cannot Give a sufficient account for their discharge in the premisses That they yet exhibite and produce the men to the saids Commissioners when they are deficient and that within the number of six dayes after the dayes of meeting heirby appointed to the saids Commissioners of Supplie respective who are heirby ordained to delyver them to Collonell George Hamilton or his order Certifying Lykeas we heirby Certifie and decerne such heretors Leaders or particular Commissioners appointed for the forsaids Levys that shall failzie in the premisses to pay each of them one hundred pounds Scotts to the officers Impoured for to receave the saids deficients which hundred pounds Scotts of penalties to be decerned for by any of the Saids Commissioners of Supplie att the Instance of the saids respective officers And the said Commissioner of Supplie is heirby Impoured to Give precepts for poynding for the same And poynding is heirby appointed to follow theron Sicklyke be in all respects as is ordained by the second act of the parliament Jaj vic sixtie nyne Intituled Act Concerning the Militia With this alteration only that the said Commissioner Director of the precept may appoint shirreff in that part any whom the forsaid officer Concerned shall Nominat provyding nevertheless that the persone found Lyable to the said fyne of one hundred pounds penaltie shall have his releiff upon the persons Lyable for the saids Levies uithin his allocation and District Conforme to the said Act and proclamations as accords And because the effectuall dispatch of this affair Doeth Much Concerne our Service Therfore we uith advyce forsaid doe peremptorly ordaine the forsaids Commissioners of Supplie to returne exact accounts of their Dilligence in the premisses to the Clerks of our privy Councill Conforme to the Certification above Specified uith all rigor Our Will is Heirfore And we Charge yow strictly and Command That Incontinent these our Letters seen ye pass to the mercat Cross of Edinburgh and to the mercat Crosses of the remanent head burghs of the severall Shires and steuartries within this kingdome And ther in our name and authority by open proclamation make Intimation of the premisses That none may pretend Ignorance And ordaines these presents to be printed Given under our signet at Edinburgh the tuenty sixth day of February And of our reigne the Eight year 16983 sic subscribitur.
