Act In favours of Alexander Steuart

Anent The petition given in and presented to The Lords of Her Majesties privy Councill By Alexander Steuart of Craigtoun Stewart Depute of Monteith Shewing That where The Deceast Sir Collin Campbell of Aberuchill Haveing been nominat by their Lordships stewart principall of Monteith Dureing pleasure and the petitioner was nominat Stewart Depute by his Lordship and accordingly as such The petitioner held Courts and did officiat for seaverall years by gone But now the Lord Aberuchill being Deceased any Commission The petitioner had from him falls in consequence soe that ther is necessarly a surceas of the Administration of Justice in that place of the Country to the great hurt and prejudice of all who live within the Jurisdiction Wpon Saturday Last The Tuenty sixth instant when their Lordships had ane Extraordinary meeting There was by way of Mistake and inadvertantly a petition presented for the petitioner And wherupon Their Lordships were pleased To pass ane Interloquitor tho not soe full and ample as the nature of the thing requyred For rectifieing wherof The petitioner humblie presumed of new to lay befoir their Lordships That not only the petitioners Commission falls By the death of the Lord Aberuchill But Lykewayes the Clerks, Fiscalls, and other officials of the Court soe that it will be necessary for the Administration of Justice in that pairt That their Lordships would be pleased To allow the petitioner a Commission in the same term’s That the Lord Aberuchill formerly receaved it Wherfore The petitioner hes heirwith given in ane authentick Double of the Lord Aberuchill his Commission And Therfore creaving to the effect aftermentioned as the said petition Bears The Lords of Her Majesties privy Councill Haveing Considered the above petition Given into them By Alexander Steuart of Craigtoun Steuart Deput of Monteith And the samen being read in their presence The saids Lords Doe heirby Appoint and ordaine The Clerks of Councill To bring into the Councill nixt Councill day Ane Commission To be granted to them Infavours of the petitioner To be steuart principall of the steuartrie of Monteith And that in the very same term’s Sir Collin Campbell of Aberuchill now Deceast had the same Dureing the Councills pleasure only, or ay and whyll The Earle of Murray should qualifie himselfe according to Law.
