Commission Infavours of Alexander Steuart To be steuart principall off the steuartry off Monteith

Commission Infavours of Alexander Steuart of Craigtoune To be steuart principall of the steuartry of Monteith upon the Decease of Sir Collin Campbell of Abberuchill on of the senators of the Colledge of Justice Being read the samen was votted and approven and ordered to be Recorded Wherof the tennor followes
The Lords of Her Majesties privy Councill – Considering That the office of steuart principall of the steuartrie of Monteith is vaccant and non Exerceing the same In respect of Charles Earle of Murray etc principall steuart of the said steuartrie and so ought to appoint ane steuart therin his being unquallified and not haveing sworn and subscrived the oath of alleadgence to Her Majestie nor haveing signed the assurance conforme to the act of parliament and proclamation’s of Councill made thereanent Therfore to have made Constituted and ordained Lykeas The saids Lords of Her Majesties privy Councill By these presents Makes Constitut’s and Ordaines Alexander Steuart of Craigtoun To be steuart principall of the said steuartry off Monteith Giveing and Granting unto him (Dureing the Councills pleasure only or ay and whyle The said Earle of Murray or his Successors Be qualefied in the termes of the saids Acts of parliament and proclamations of Councill) The office of Steuart principall in the said steuartry of Monteith With all and sundrie powers, Jurisidction’s priviledges, prelimences, fies dewties Casuallites, profits, Liberties, and Immunites whatsomever therto belonging as the samen were possest and enjoyed by any preceeding steuart principall of the forsaid steuartrie With power To the said Alexander Steuart Dureing the space forsaid To use and Exerce the said office of Steuart principall within the said steuartry By sitting and holding Courts, Judgeing Decyding and Determining in all actions, Causes als weell Civill as Criminall Bloods, and Ryott’s and upon lyfe and Limb and all other actiones and affaires pertaining to the said office of steuart principall of the said steuartry als fully and freely in all respects and Conditiones as any other steuart of the said steuartry was in use and had right to doe of befoir And to make Creat and substitute Deputs, and substituts under him in the affoirsaid office (for whom he is to be answerable) With Clerks, officers serjants, Dempsters, and other members of Court And the samen als oft as need bees to alter and Change And to intromitt with and uptake all fies Casuallites, Comodites, duties, and profits belonging to the said office Dureing the space abovementioned, With all Bloodwitts Escheits and amerciaments of the said Court of Steuartrie And Generally With power to the said Alexander Steuart As Steuart principall of the said steuartrie of Monteith To doe use and Exerce All and Sundrie other things Concerning, pertaining and belonging to the said office of Steuart principall of the said stewartrie Dureing the forsaid space alse fully and freely in all respects As any other steuart of the said steuartry hes done used or Exerced The said Alexander Steuart befoir he enter to Exerce the said office of Steuart principall of the said steuartry of Monteith first swearing the oath of Alleadgence and signing the same with the assurance To Her Majestie Conforme to the acts of parliament and proclamation’s of Councill made thereanent Given Att Edinburgh The fourtheen day of March Jaj vijc and four years sic subscribitur Buchan I:P:D Loudoun Glasgow Garnock Primrose Hew Dalrymple Robert Stewart Robert Mkenzie F Montgomrie H Cuninghame J Steuart W Morisone
