Commission To Mr Robert Douglas and Stewart of Burray To Be Stewarts of Orkney and Zetland

Commission by the Councill In favors of Mr Robert Douglas brother german to the Earle of Mortone and Sir Archibald Stewart of Burray Barronet Conjunctllie and Severallie to be Stewarts of her Majesties Stewartrie of Orkney and Zetland and Justiciars within the bounds and Isslands therof Read voted aproven and Signed, Wherof the tenor followes.
Forasmuchas her Majesties high Commissioner and the remanent Lords of her Majesties privy Councill Considering how necessar it is for her Majesties Service and the well fare and hapines of her Majesties Subjects within the Isslands of Orkney and Zetland, That Some fitt and qualified persones of known intrest and integrity in these parts as well as Loyaltie and affection to her Majesties government be Nominat and appointed for exerceing the office and trust of Stewart and Justiciar of the saids Isslands And Her Majesties high Commissioner and the Saids Lords being Sufficiently informed and assured of the ability fidelity Carefullnes and Loyaltie of Mr Robert Douglas brother German to the Earle of Mortoune and Sir Archibald Stewart of Burray barronet, and of their fittnes for discharging the saids offices and trust Therfore her Majesties high Commissioner and the Saids Lords of her Majesties privy Councill Nominates Constitutes and Appoints the said Mr Robert Douglas and Sir Archibald Stewart Joyntly and Severally To be Stewarts of her Majesties Stewartrie of Orkney and Zetland and Justiciars within the whole bounds and Isslands therof as well these parts which formerly pertained to the Bishops as all others whatsomever Likeas her Majesties high Commissioner and the Saids Lords of her Majesties privy Councill hereby Gives and Grants to the Said Master Robert Douglas and Sir Archibald Stewart the forsaids offices of Stewart and Justiciar of Orkney and Zetland and haill bounds and Isslands of the Same with the honours priviledges fies Casualities fynes and amerciaments profitts and Emoluments whatsomever therto belonging With full power and authority to the Said Mr Robert Douglas and the said Sir Archibald Stewart Joyntly and Severally As Said is; And their deputs and Substitutes one or moe to be Nominat by them in the forsaid offices for whom they Shall be answerable to Sett affix affirme hold and Continue Stewart and Justiciar Courts within any part 2 or3 place of the forsaids Isslands and Jurisdictiones that they Shall think fitt, administer and doe Justice therin in all actiones and Causes Civill and Criminall Conforme to the Lawes and practiqs of this kingdome Acts to make Decreets and Sentances to pronounce And the Samen to due execution cause be put, And to Nominat Creat and appoint procurator Fiscalls officers Demsters; and all other members of the said Stewart and Justiciar Courts needfull and to alter and Change them at their pleasure; And generally with power to the Said Mr Robert Douglas and Sir Archibald Stewart to doe use and exerce all and Sundrie other things necessar and requisit in the forsaid offices; Sicklyke and alse freely in all respects as any other Stewart and Justiciary of Orkney and Zetland did or might have done at any time heretofore; And it is hereby expressly provided that the forsaid Mr Robert and Sir Archibald Shall hold Courts at all times when requyred by her Majesties Chamberlands or tacksmen and give process and administer Justice therin, and give Sentances and Cause execute the Same for bringing in her Majesties rents in the most effectuall maner according to Law. And Last Doe hereby Recall all Commissiones of Stewartrie and Justiciary of the forsaids Islands granted to any persone or persones before the date hereof; And thir presents to Continue ay and while the recalling hereof be intimat in these parts Sic Subscribitur Queensberry Commissioner Marchmont Cancelar; Lothian Seafield, Mar; Northesk Tarbat, Boyle, C Campbell Pattrick Johnstone.
