Act Liberating Thomas Spence
Anent The Petition given in To the Lords of his majesties privy Councill By Thomas Spence prisoner in the Tolbooth of Edinburgh Shewing That Being now by order of their Lordships Imprisoned, and not Knowing the precise point upon which he is Incarcerat, he can the Less plead apposite Excuses, only if there be any thing alleadged of his Encourageing and Countinanceing of Rables, These He can say he aborres, And in his abhorrence of them as commonly sad, and dangerous in their consequences, He Thought he Took a Regular method to prevent Such disorder, And if he hes been in ane Error that way He can say he hes been Led into it by acts of Parliament. Viz: The one hundreth and Thirteenth act, parliament Seventh, James Sixth, Two hundreth and fiftieth act, parliament fifteenth James Sixth, fourtieth act, parliament First. Session first Chap: second Fourty sixth act parliament first, chap: second, and Twelfth act of the parliament Jaj vic Eighty one, And all these unrescinded and set down as such in my Lord Advocates Abridgement of the acts of parliament And Therfore he presumes their Lordships would Reconsider his case And favourably construct That he designed nothing but the faithfull discharge of his duty as a servant To the King, moving (In his masters absence as he could) for the good of the Kingdom, His master having always allowed him To give concurrences in all processes wherin his name is assumed for the publict Interest as can be attested by their Lordships Clerks. And Seing his designe was good and virtous how unsuccessfull soever, And Therfore Humbly craving To the Effect underwrittin as the Said petition Bears. The saids Lords of his majesties privy Councill Having considered this petition petition2 given in to them by Thomas Spence Servitor To Sir James Stewart his majesties Advocate, They heirby give order and warrant To the magistrats of Edinburgh and keeper of their Tolbooth To sett the said Thomas Spence att Liberty further thereof, For which this shall be to all concerned a sufficient warrand.
