Reprive To John McTavish and Hugh Finser

Anent The Petition given in to the Lords of his Majesties privy Councill By John McTavish of Migavy and Hugh Fraser prisoners in the Tolbooth of Edinburgh Shewing That whereas their petitioners having hade the misfortune throw Ignorance and Impudence, to be concerned with some others of their Freinds in meetings and Gatherings, That were Found to Fall under the Compass of the Laws and Statutes dischargeing Gatherings and Convocations, of the Leidges under the pain of Treason, whilest in the mean tyme, They never in the least harboured any thoughts of opposing his majesties authority wherupon having been pursued before the Lords of Justiciary The Sentence of death was pronunced against them some tyme agoe To the Executeing therof Their Lordships in compassion of their petitioners Circumstances were pleased to put a Stop by granting them a Reprive till the First of December next which is now near Expired; They have Therfore Recourse once more to their Lordships Goodness and Compassion For a Continuation of the said Reprive For such a competent tyme as their Lordships Shall think Fitt. That they2 may have opportunity to Implore his majesties gracious pardon, whose clemency was never wanting to any that became obnoxious To punishment Through Rashness and Simplicity without any design against his authority and Government. And Therfore Humbly craving their Lordships In commiserating of their Petitioners Circumstances To prorogate the said Reprive For a competent tyme, or Change the said Capitall punishment to Banishment or what Else their Lordships shall determine, as the said petition bears. The saids Lords of his majesties privy Councill Having Considered this Petition given in to them by John McTavish of Miggavie and Hugh Fraser prisoners in Edinburgh Tolbooth, They heirby Reprive the Petitioners from the sentence of death pronunced against them, untill the Second Friday of January next to come, And have discharged, and heirby Discharges the magistrats of Edinburgh to putt the said sentence to Execution against the petitioners untill the said day, And ordaines them without any Farder delay.
