Act Banishing Severalls To America and Liberating others
The Report of the Committee anent persons whose sentences have been by the Councill changed from death to Banishment Being this day read in presence of the Lords of his Majesties privy Councill, They heirby ordain John Scarlet, Robert James, William Patrick and William Baillies Egyptians prisoners in the tolbooth of Edinburgh To Find caution in the terms of the former Interloquitor of Councill pronunced upon the 19th of January last anent them and that against Twesday next Being the 14th day of February Instant with Certification if they doe not Find caution in the termes forsaids against that tyme, That their Lordships will appoint a day for putting the former Sentence of death pronunced by the Lords Commissioners of his Majesties Justiciary, To Execution against them and if the saids Five persons find caution, The Councill ordaines them and the rest of the persons whose sentences are Commuted to be Transported to America in the terms of their respective Sentences of Councill, and to be sent off by the first ship that shall be licensed to go thither, And decernes and ordains the person who shal obtain the License for the said first Ship, To give Bond immediatly after Receaving of the said License to maintain the persons prisoners whom he shall have liberty To Transport at four shillings Scots per diem during their Remaining in prison after the date of the license so to be obtained, The saids persons Enacting themselves and finding caution as in their respective Interloquitors of Councill, And The saids Lords of his majesties privy Councill Have banished and heirby banishes Thomas Anderson, William Cowan, Charles Howard, John Davidson and John Brown, all prisoners in the Tolbooth of Edinburgh furth of his Majesties Dominions, to his Majesties plantations in America, The saids 5 persons first Inacting themselves in the books of his Majesties privy Councill and giving their Consent that they shall depairt furth of his Majesties dominions and Repair to his Majesties plantations in America and never Return within his Majesties said Dominions, and the saids Lords of privy Councill doe heirby give order and warrand To the magistrates of Edinburgh and keeper of their Tolbooth To set at liberty furth thereof the persons of Margaret Bailie Helen Anderson John Cook and Robert Alexander presently prisoners therein The said John Cook and Robert Alexander first inacting themselves in the books of privy Councill that they shall live peaceably and in good behaviour in tyme coming, and that they shall apear before the saids Lords of his majesties privy Councill or the Lords Commissioners of Justiciary, whenever they shall be called for or Required thereto under the penalty of 500 merks the peice And Remits John Finnay servant to John Forbes late agent for the Regiment att Fortwilliam To the magistrates of Edinburgh to be tryed and published by them for his pickery as they shall Find Just.
