Proclamation

Proclamation Allowing the free Transporting of victuall from one Shire to another and the Importation of Forraign victuall free of custom, and Twenty Shilling Scots, for Each imported Boll thereof

The following Proclamation Being Read was voted approven and and2 signed. Whereof the Tenor follows
William By the grace of God, King of great Brittain, France and Ireland defender of the faith To […] Macers of our privy Councill, messengers att armes, our Sheriffs in that pairt, conjunctly and Severally Specialy constitute Greeting Forasmuchas The growing necessity of the poorer Sort of our Subjects in many pairts of this Kingdom, Doe Require our Special care for their Releif; And albeit several methods have been Laid down, and measures prescribed by former proclamations of our privy Councill, To have Supplied and provided them at Reasonable and Easie Rates by the native product and Grouth of this Kingdom yet through the present Scarcity Their being Several places in the Countrey not able to Subsist upon the grouth and victuall within their own Bounds, And in other places the poorer Sort not able competently to provide themselves att the current Rates: All which does necessarly Require That both their may be a free course of Buying and Selling victual through the whole Kingdom, And likewise all Encouragement given for Importing victuall from any forraign Countrey or Kingdom to this nation, during the Space aftermentioned And That this hopefull Season gives good Ground To Expect ane Earlie Harvest, So that a Small Supply from abroad, may afoord great Releif, and Keep the mercats at a moderat Rate:3 Therfore, and To the Effect the mercats may be duely Supplied and furnished with victuall that is yet within the Countrey and Likeways with Forraign victuall by any who shall Import the same We with advice of the Lords of our privy Councill not only Ratifie and Approve all former proclamationes acts orders and Commissiones against Regraters of victuall and forestallers of the mercats, And ordain and Require the same to be punctually observed and put to Execution according to the Tenor theirof and acts of parliament made thereanent, In so far as may Extend To or Concern Regrating of victuall and forestalling of mercats, But likeways Wee with Advice forsaid, Doe heirby grant Licence, and full Liberty to all persons whatsomever, forraigners or natives, To Import victuall or Corns of all Sorts Either by Sea or Land from any other Kingdom or Countrey whatsomever untill the fifteenth day of August next to come, and that free of Custom, Excise or other Impositiones, for all that shall be Imported after the date heirof during the time forsaid And Recommends it To the Commissioners of our Thesaury, To discharge the Exacting of any Such Custom, Excise or Imposition for the said victuall, to be Imported. notwithstanding of any act of Parliament or Book of Rates Imposing the Same, And For A farder Incouradgement and Invitation To all such who shall Import and bring in to this Kingdom, victual or Corn of any sort Betwixt and the day forsaid, We with Advice of the Lords of our privy Councill, Doe heirby Appoint and ordain the soume of Twenty Shilling Scots for Each Boll of the said forraign victuall, Imported after the day and date heirof, and before the said fifteenth day of August next, To be Immediatly given and paid out of our Customs to the Importer thereof, upon his oath of verity of the number of Bolls Imported by him, Taken in presence of any of the Sheriffs of the Several Shires of this Kingdom, Bailies of Regalities or Bailiaries, Stewarts of the Stewartries, or their respective Deputs, Magistrats of Burghs, or any one of the Commissioners of Supply or Justices of Peace within the Same, Subscribed with their hand, and attested by the forsaids Judges, and of which Twenty Shilling Scots, We with advice forsaid Require and command The Tacksmen and farmers of our customes, and their Collectors and other Receavers att the respective custom-houses, To make present and Immediat payment for Each Boll of Forraign victuall Imported by Sea or Land To the Importer thereof, upon his receit to be given upon the Back of the forsaid Subscribed oath of the number of Bolls Imported, And which Receit Wee with advice forsaid, Declare and ordain To be a Sufficient Exoneration To the Saids Tacksmen and farmers of our Customes and their Collectors of their Said Tack-duty, And to be Allowed to them in the fore End thereof pro tanto, Certifieing Such of the Saids collectors or other By the Tacksmen And farmers of our Saids Customes, That if They failzie To make due and punctuall payment of the said Twenty Shilling Scots, for Each Boll of Imported victuall or postpone and delay the Importers thereof, in the Ready payment of the said Soume when the said Subscrived oath and Receit is offered to them, they shall not only be declared and ipso facto theirby become Incapable To Serve or be Imployed by our said farmers in any office or Trust under them, in uplifting our saids Customs, But be farther lyable in the double of what they shall So Refuse or postpone the payment of as penalty and damnages to be Recovered from them by the pairtie by thir presents, and the forsaid subscribed oath upon process to be Intented therfore, and verified by Instrument taken against the saids collectors or Receavers Requireing payment in manner abovementioned, And further To the Effect all our Subjects within this Kingdom, may be supplyed and Releaved out of the native product and Growth of this Kingdom, with all possible Equality and proportion in the mean tyme We with Advice forsaid give full Liberty and permission, To a free course of mercats for selling victuall Through all pairts of the Kingdom whether the said victuall or corn was the Grouth of the Shire where it is sold or not, and that at what Rates and prices, Either of Ready money or to a day the buyer and sellers can best Agree upon, and heirby discharges all persons whatsoever from Troubling or molesting any person whatsoever in the Transporting Victuall to mercats, or otherways from one Shire to another, under their highest perill. Our Will is Heirfore. And we charge yow Strictly and command That Incontinent these our Letters seen ye pass to the mercat cross of Edinburgh and Remanent mercat crosses of the head Burghs of the severall Shires and Stewartries within this Kingdom and therat in our name and authority by open proclamation make Intimation heirof, That none pretend Ignorance, And ordains these presents to be printed. Given under our Signet att Edinburgh, The nynth day of June. And of our Reign the Eleventh year 1699 Sic subscribitur.
