Att Edinburgh The nynth day of June Jaj vjc nynty Eight years

Act

Act Changing the sentence of Death pronounced against Malcolm Moir To Banishment

The Lords of his Majesties privy Councill Having Considered a Petition given in to them by Malcolme Moir alias Reid with the Extract of the Criminall process and depositiones of the witnesses Contained in the said Extract and the declaration by the father and mother of the Child Killed In favours of The petitioner both mentioned in and produced with the petition. They doe heirby Change and Commute the sentence of Death pronunced against the petitioner for killing the said Child to Banishment, And have Banished and heirby Banishes the said Malcolme Moir alias Reid furth of his Majesties Dominions To his Majesties plantations in America And ordains The Petitioner before Extracting heirof To give and Find sufficient Caution acted in the Books of privy Councill That he shall depairt Furth of his majesties Dominions in the First ships going for his majesties plantations in America and that betwixt and the First day of September next to come and that he shall Transport himself to the saids plantations, And upon his arryvall there shall Transmitt a Certificate under the hands of the Skipper of the ship wherein he shall be Transported And also under the hands of the magistrats of the place at which he shall be Landed, to the privy Councill of the same, and that betwixt and the First day of June Jaj vic nyntie nyne years under the penalty of Ane Thousand merks Scots In caice he shall Transgress in any pairt of the premises And also before Extracting heirof ordains the Petitioner to give Bond without Caution That he shall never Return within his Majesties Dominions att any tyme hereafter under the pain of having the forsaid sentence of death pronunced against him putt to Execution against him without mercy or delay And upon granting of the forsaids bonds The said Lords ordains The magistrats of Perth To Cause carry the Petitioner from their tolbooth to the First ships going for America and to take Care That they see him Conveyed to and shipped in the said ship.
