Decreit His Majesties Advocate Against Mr William Wilson

Anent the Lyble or Letters of Complaint Raised and pursued before the Lords of his Majesties privy Councill att the Instance of Sir James Stewart his Majesties Advocate for his highness Interest in the matter underwrittin Making Mention That where By the act of Parliament Jaj vic sixtie one Against Clandestine marriadges The Celebrator of such marriadges is ordained to be Banished the Kingdom never to Return under the pain of Death. Nevertheless It is of verity That Mr Wiliam Wilson Late minister at Couper and now prisoner in the Tolbooth of Edinburgh Hath Celebrate severall Clandestine marriadges, and particularly did marry clandestinely William Waddell To […] Both Resideing in St Andrews, as Appears by his Declaration and Confession under his hand ready to be produced. Wherby it is manifest that the said Mr William is Guilty airt and pairt of the said Cryme, And ought to be therfore punished by the said pain of Law, To the Example and Terror of others to Committ the Like in tymecoming. And Anent The Charge given to the said Defender To have Compeared before the Lords of his Majesties privy Councill at ane certan day bygone To have Answered to the grounds of the above Complaint and to have heard and seen such order and Course taken thereanent as the saids Lords should Think under the pain of Rebellion and putting of him To the horn with Certificatione etc as in the principall Lyble or Letters of Complaint with the Executiones thereof Raised in the said matter att more Length is Contained. Which Lyble Being this day Called In presence of the Lords of his Majesties privy Councill. And The persuer Compearing personally, and The Defender also Compearing personally. And The Lord Advocat persuer Having given in the Defenders Confession which being read and The defender having acknowledged the same. The saids Lords Having Considered the points and articles of the Lyble with the Defenders Confession and his owning the same. They find the points and articles of the Lyble Sufficiently proven by the defenders Confession and owning the samen. And The saids Lords of his Majesties privy Councill In Respect of the defenders meanness and Low Circumstances and great Burden of small children whom he hath to sustain. Doe heirby ordain the Defender To be carried back to the Tolbooth of Edinburgh From whence he was brought therein to Remain prisoner during the councills pleasure.
