Warrant for Recalling the Certification granted against the Earle of Seaforth
The Letters of Horning or Lyble att his Majesties Advocates Instance against the Earle of Seaforth wherin Ther was Certification granted against the said Earle upon the fourth of January Last bypast Being this day called in presence of the Lords of his majesties privy Councill And the said Lord Advocate and Sir Patrick Home his majesties Sollicitor Compearing personally for his majesties Interest as pursuers And The said Earle of Seaforth Defender Compearing also personally with Mr David Dalrymple Mr […] Cockburn Mr John Kincaid Mr David Forbes and Mr William Brodie his Advocats. The saids Lords having removed the Earle and having advised and Considered the Certification granted against him upon this same Lyble or Horning dated the fourth of January Last And finding that the said Certification is not yet Extracted nor the Earle denunced therupon. The saids Lords Doe heirby Recall the said Certification and have Reponed and heirby Repones the Earle of Seaforth against the same, And The Earle being of new called in and Compearing with his Lawiers forsaids The Lyable or horning being again Read and the Earles written answers being also Read And Both parties and the Lawiers being fully heard The saids Lords doe heirby Continue the said process untill the next Councill day And In the mean Tyme appoints the Earle to Give Bond And find the Lord Forbes and The Laird of Grant Cautioners therin That he shall appear and Sist himself att the Councill Barr upon Thursday the seventeenth of February Instant under the penalty of Two Thousand pound sterling in caice of failzie.
