Act In favours of Leivtennent Coll John Ereskine
Anent the Petition given in to His Grace His majesties high Commissioner and the Lords of His Majesties privy Councill by Livetennent Colonell John Erskyne, Governour of Dumbarton Castle, Shewing That when he hade the Command of Stirling Castle, he did advance to Henry Payne prisoner there, about one Thousand Three Hundered pounds Scots, all which he shall Instruct (Except a Small pairt) was advanced when he hade no Setled mean of Subsistance, but only ane Insinuation of being alimented when continued prisoner by the Parliament Jaj vic nynty three, and There being a Recommendation by the parliament to the King in the year Jaj vic nynty Six for Setting the said Henry Payne at liberty and paying the debts he hade Contracted for his Subsistance in prison, by which the petitioner did Expect payment from the Government who have allowed him Subsistance Since that tyme, and now there being Warrand granted for the Liberation of the said Mr Payne, And Therfore Humbly Craving in manner and to the Effect underwrittin as the said petition bears. His Majesties high Commissioner, and the Lords of his majesties privy Councill having Considered this petition given in to them by the above Livetennent Colonell John Erskyne anent the debt due to him by the above Henry Payne, They heirby Recommend to the Lords Commissioners of His Majesties Thesaury, to cause make payment to the said petitioner of the above Soume, The petitioner always Instructing what is due to him before the saids Lords Commissioners.
