Warrant for carrieing Gibriall Johnston abroad to be a Souldier
Anent a petition given in to the Lords of his Majesties privy Councill be Gabriall Johnston prisoner in the Tolbooth of Edinburgh Shewing That the petitioner haveing come from Ireland and taken up his residence in Cumnoch in Scotland within these two years The petitioner was by Some of his Malicious Nighbours misrepresented to Mr William Dalrymple husband to the Countes of Dumfrees as guilty of false Coyneing and upon his information by vertue of ane order from his Majesties advocat; The petitioner was Summarly apprehended and incarcerat The petitioner hade now Lyen these two moneths in prison almost in a Sterveing condition And there is non that appears to Lay any thing to the petitioners charge And at Length had been examined by his Majesties advocat who did not find the petitioner in any respect guilty But to Save the Credit of the informer, and that the petitioner might not be altogither without ground Imprisoned His Lordship had been pleased to requyre that the petitioner Should enact himself to Leave the kingdome which the petitioner Should enact himself to Leave the kingdome which the petitioner was very willing to doe And therupon his Lordship had promised to move this day in Councill that the petitioner might this day have his Liberation; And Therfore Humbly Craveing the Saids Lords would be pleased Since ther wes no person that appears to accuse the petitioner tho he had now Lyen these two moneths in prison, And that the petitioner was only upon misinformation and groundles envy incarcerat Therfore to ordaine his Liberation And in regaird he hade nothing wherwith to pay the dues to the keeper of the prison and aliement while ther to ordaine the petitioner to be discharged without paying any thing upon aither of these accompts Since he was Imprisoned for a publict Cryme tho without all ground; As the petition bears The Lords of his Majesties privy Councill haveing Considered the above petition given in to them by the above Gabriall Johnston They Doe hereby Give order and warrand to the Magistrats of Edinburgh and keeper of their Tolbooth to Sett the Said petitioner at Libertie furth therof and to delyver him to Captain […] Lindsay brother to the Earle of Crafurd in […] Regiment To be caried abroad by him to Holland or Flanders as a Souldier in his Majesties Service; The said petitioner allwayes first before extracting subscrybeing a Consent wherby he consents of his oun accord to be caried abroad to the effect forsaid, and giveing in the same to the Clerks of privy Councill.
