Procedure

Recommendatione to her Majesties Advocat to Sist the person of John Moncreiff nottar in Pearth befor them

The Lords of his Majesties privy Councill Doe hereby Recommend to Sir James Stewart his Majesties advocat To cause Sist before them against Teusday nixt being the Twenty fifth instant the person of John Moncreiff Nottar in Pearth; And that aither by Letters or any other maner of way his Lordship Shall think fit To answer for the defence proponed by him for Hewgh McClean a Dragoon Viz That ther was no Statutory Law against the Drinking of King James the Eight his health; And the saids Lords Nominat and appointed the Marques of Annandale and Thesaurer depute; Lord Philiphaugh and Lord Rankeillor to be a Committie to Consider the decreets under the hand of John Richardson Shirrif Clerk depute of Pearth at the instance of John Whyt procurator fiscall of the said Court and Androw Couper portioner of Scoon, Against Duncan Angus Servitor to Francis Scot Cornet to Captain Prestounes troop; And to examine the the2 Shiriff depute of Pearth and Androw Couper bailly of Scoon how the said defence proponed by John Moncreiff procurator Viz That ther was no Statutory Law against the Drinking King James the Eight his health Came to be insert in the said decreet; And farder he enquyre in their procedure in the said matter And Declares any two of the said Committie to be a Sufficient Quorum; And Recommends to them to meet the morow at ten in the forenoon.
