Anent The Petition given in to the Lords of His majestys privy Councill by Ensign James Gibsone Shewing That where he being Commissionat to Scotland for Levying men to Recruit the Regiment Commanded by Colonell Robert Murray now lying in Holland, and having used all the moyen and pains possible he could to make up his Complement, notwithstanding frustrat And Seing Robert Mun who hes been lately Imprisoned in the tolbooth of Edinburgh at the Instance of My Lord Montgomery upon Suspicion of Theft is willing and Content to go alongst with the petitioner, to be one of the Recruits in the said Regiment as ane declaration under his hand and attested by one of the Magistrats of the Said burgh as the samen therwith produced bears. And Considering their Petitioner applyed to their Lordships formerly for Severall prisoners that were So Imprisoned, and that their Lordships then Refused to grant the same but declared, That what ever prisoners for Such Crymes Should therafter be Imprisoned, that he Should be allowed the benefit therof, And Therfore Humbly Craving to the Effect underwrittin as the said petition bears. The Saids Lords of His Majestys Privy Councill having Considered the above Petition given in to them by Ensign James Gibsone, with the declaration mentioned therin and produced therwith, They hereby give order and Warrant to the magistrats of Edinburgh, and keeper of their tolbooth, to sett Robert Mun presently prisoner therin at Liberty furth therof, and to deliver him to the petitioner To the Effect the Said Robert Mun may go alongst with the petitioner to Serve as one of the Recruits in the Regiment Commanded by Colonell Robert Murray now lying in Holland, In Respect of the said Robert his Consent therto in manner forsaid.
