Decreet

Decreet of Deprivation John Blair Kirk agent Against Mr Duncan Comrie

Anent the Lybell or Letters of Complaint raised and persewed before the Lords of his Majesties privy Councill At the Instance of John Blair agent for the kirk with Concourse of Sir James Stewart his Majesties advocat for his hignes intrest in the matter underwritten Making Mention That wherby the Sixth act of the Fourth Session of this Current parliament entitulled act for takeing the oath of alledgance and assurance It is Statute and ordained That all Ministers and preachers of the Gospell whatsomever Shall Swear the oath of alledgance to his majestie and Subscrybe the same with the assurance Certifieing such ministers that are provided to kirks and shall refuse the same should be deprived of ther benefices and Stipends Likas by the proclamation of the meetting of the Estates dated the threteinth day of Aprile Jaj vic Eightie Nyne years all the leidges are discharged to oun the late King James and appointed publictly to pray for his Majestie King William; yett nevertheless It is of verity That contrair to the said act and proclamation Mr Duncan Comrie present incumbent at the paroch of Inch Callioch alias Buchannan Continues and presumes to preach and exercise the other parts of the Ministeriall function without haveing qualified himself Conforme to the appointment of the said act By Swearing the said oath of alledgance and Subscrybeing the Same with the assurance; Wherby he has incurred the Certification Contained in the said act as use is in Such caices Lykeas the said Mr Duncan Comrie does not pray for his majestie King William But said as long as his Blackhead was on his neck he would not pray for King William, and contrary to the said proclamation of the Estates and act of parliament ownes the late King James and publictly prayes for him by the name of the distressed King and sayes it’s the duty of all men to rise and asist him when he comes in and desired the people to rise with him; And furder it is informed that ever since the happy revolution; The said Mr Duncan Comrie neglects to read the publict proclamation appointed by authority for observing Solemn dayes of fastings and thanksgiveings; and instead of obeying he dispises and mocks at the Causes and reasones Contained therin; And Still continues in the said paroch infesting and troubling that bounds to the great disqueit of the Setled order and peace of this Church, By all which the said Mr Duncan Comrie being guilty airt and pairt of the forsaid transgression, and disorders he ought to be punished therfore with the paines of Law; And furder effectually restrained for hereafter from Committing of any Such abuses to the example and terror of others to Committ the Like in time comeing; And Anent the Charge given to the said Mr Duncan Comrie defender To Compeared personally before the saids Lords of his majesties privy Councill at ane Certaine day now bygone To have answered to the points of the said Complaint and to have heard and Seen Such order and Course taken theranent as they should find Just As the said Lybell or Letters of Complaint and executiones therof at more Length is contained Which Lybell being upon the Twentie second day of July instant Called in presence of the saids Lords of his Majesties privy Councill, And the said [John Blair pursuer Compearing personally with Sir James Stewart his majesties advocat, And the said Mr Duncan Comrie defender being oft times called and not Compearing, And Mr David Cunninghame advocat Compearing for him; The Councill Doe hereby Delay any present proceeding against the defender In respect he only renewed a short Copie of the Letters And the saids Lords Allowed the said Mr Duncan Comrie to appear and be heard upon Thursday nixt being the twentie Fourth instant And Ordained him to appear and answer that day peremptorie; And In respect ther was ane instrument produced bearing that since he hade gotten a full Copie which was read Which Lybell being this day again called In presence of the saids Lords of his Majesties privy Councill, And the said John Blair and Sir James Stewart his Majesties advocat Compearing personally as pursuers, And the said defender being Lawfully cited oft times called and not Compearing The saids Lords Haveing Considered the forsaid Lybell and points and articles therof They have Deprived and hereby Deprives the said Mr Duncan Comrie from his office at the paroch Kirk of Inchcallioch alias Buchannan or within the said paroch and have Declared and hereby Declaires the said paroch Kirk to be vaccant, And appoints the said Mr Duncan Comrie to flitt and remove himself his wife familly and servants furth and frae the said paroch of Inchcallioch Manse and Gleib belonging therto; And to Leave the Samen void and redd betwixt and the time of Michaellmess nixt to come And Discharges him to preach or exercise any part of his Ministeriall function within the said parish, And Decernes and Ordaines the said Mr Duncan Comrie to remove himself furth of the said paroch of Inchcallioch and bounds therof betwixt and the terme forsaid And Ordaines Letters of horning on Fiftein dayes under the Signet of privy Councill and other executorialls needfull to pass hereon in forme as effeirs.
