Act Scott of Hedderwick

Anent the petitione given in to the Lords of Majesties Privy Councill by David Scot of Hedderwick Shewing That the petitioner haveing been a long tyme consumptive and troubled with violent and frequent spittings of blood is redacted to such a dangerous state of bodie that Phisicians have advijsed him as the Last remedey to goe to Mont Pellier or some other part in the South of France for recoverie of his heath whereanent two eminent Phisicians of this place have given their testificat on soull and conscience which (for2 though the said petitioners conditione be a thing nottour) yet the petitioner produced with the said petitione to evince to the said Lords the trueth of what he represents and seeing the place he is advised to goe to lyes in the Kingdome of France from which (3as being ane Enemeys Countrey all his majesties subjects are debarred by act of parliament without the said Lords their Libertie find licence first had and obtained The said petitioner did humbly lay before the said Lords his evill Conditione and the last advyse given him by Phisitians and further represents that it will be convenient for him to begin his journey with the Spring and that there is a necessity lykewayes of his takeing one of his Brothers along with him that may be assisting to him either in the case of lyfe or death and so hopes the said Lords would have so much compassione upon one in his Circumstances as to allow him and his said brother the libertie desyred And therfore Humblie Craveing the said Lords might consider the premisses and to grant a pass to the said petitioner and to Patrick Scott his Brother for goeing to Montpellier or any other place in the South of France proper for recoverie of his health as the said Petitione bears The Lords of his Majesties privy Councill haveing Considered said petitione given in to them by the said David Scott of Hedderwick with the testificat under the Hands of Doctor Halket and Doctor Pitcairne They conforme to the power granted to them conforme to the act of parliament allow and permitt the said petitioner and Patrick Scott his Brother to the Kingdome of France and hereby Recomends to the Earle of Annandale president of Councill to signe a pass in name of the Councill to the said petitioner and Patrick Scott his said Brother To travell to Montpellier or any other place in the South Kingdome of France propper for recovering his health The said David Scot and the said Patrick Scott his Brother first giving bond and finding sufficient Cautione acted in the books of privy Councill That they shall not carrie letters of intelligence or other informatione against the Goverment Into France nor keep correspondence for intelligence to the prejudice of his Majesties Government dureing their abode within the Kingdome of France or Countreys subject to that Croune under the penalty of fyve thousand merks scots in case they shall transgress in any part of the premisses
