Act Stuart of Ballachane and his Brother
Anent the petitione given in to the Lords of his majesties privie Councill by Patrick Stueart of Ballaquhan and Alexander Stueart his Brother Shewing that where the said petitioners are Prisoners in in2 the Cannongate Tolbooth now these tuentie seven moneths and now of late liveing upon their Lordships Charity.yet considering the vast Loss their poor families sustaine by their absence and their heath for want of the benefitt of the free aire And therfore Humblie Craveing in maner and to the effect aftermentioned as the said petitione bears The Lords of his majesties privy Councill haveing considered the foresaid petitione given in to them by the said Patrick and Alexander Stuearts They Hereby give ordor and warrand to the magistratts of Edinburgh Baillies of the Cannongate and keeper of their Tolbooth to sett the saids petitioners at Liberty furth thereof And confynes them to the toune of Edinburgh and suburbs thereof and two myles about the Same In respect they have given bond and found sufficent Cautione acted in the books of privy Councill That they shall keep their Confynement and not goe without the same and that they shall Live peaceablie under with all submissione to the present Government of his majestie King William and that they shall not act consult of Contryve any thing to the prejudice thereof nor shall nor converse nor correspond with any Rebells and shall appear before the said Lords of privy Councill when called for under the penalty of fiftie pound starline apeice in case they shall transgress in any part of the premisses
