Proclamatione for Collecting and inbringing the polemoney 1695

The following proclamatione being read in Councill was approven and signed and ordored to be recorded whereof the tenor followeth a proclamatione for collecting and imbringing the pole money appoynted to be payed at martinmass Jaj vjc nynty and fyve by ane act of the Last sessione of parliament William by the grace of God King of great Brittane France and Ireland defender of the faith to […] macers of our privy Councill messengers at armes our shirriffs in that part conjunctlly and severally specially Constitut greeting2 Forasmuch as we have thought good that the pole money imposed by ane act of the last sessione of our Currant Parliament shall be uplifted and ingathered by way of Collectione Therfore we with advyse of the Lords of our privy Councill and conforme to the Reference made to them by the said act Have ordained and Hereby ordaine That the foresaid pole money be uplifted collected and brought in at the Sight and by the instructions of the Commissioners for supply throughout the whole shyres of the Kingdome in maner following viz that the said Commissioners or ther quorum appoynted by the foresaid act of parliament to meet and subdivyde themselves for takeing up rolls and lists of all the poleable persons within their respective bounds the dayes and in maner mentioned in the said Act doe at the said dayes subdivyde themselves appoynting two either of their owne number or of the Heretors of every paroch for each paroch,3 with power to the said sub Commissioners at their meeting in the said paroches for takeing up rolls as said is4 To Choise and nominat a fitt and Responsall persone to be both Clerk and Collector of the pole in that paroch as also to call the Elders or Deacons or other fitt persons within the paroch and Cause them give up upon oath to the best of their knowledge the names of all the persones within the paroch and to Cause every house keeper give up the number names and quality of all within house Which names with the qualities and degrees of the persons and the Conditiones of their Estates as they stand poleable by the said act of parliament are to be set doune by the said Clerk in a list or Roll at the sight of the said two sub-Commissioners for that end and the same with the sum that the whole pole amounts to is to be subscryved by the said Commissioners (who are Hereby fully impowered to enroll the same and to determine all questions arriseing theron) and their Clerk and then to be given in to the Collector of the Supply within the Shyre who is to Registratt the same in a book to be keept by him for that effect, and Extracts of the Roll of every paroch are to be subscryved and given out by the Collector of the Shyre to the Subcollectors of the paroch, for uplifting an ingathering of the ums therin contained and the List and Rolls of the Paroches within the Shyre being brought and booked and recorded as said is The book shall be subscryved by the Commissioners of the Shyre or their quorum and ane authentick double thereof under the Commissioners and their Subcollectors Hands sent in to the Lords of the Thesaurie betwixt and the day appoynted by the said act of parliament and the foresaid Subcollectors of the said paroches getting subscryved extracts of the Rolls as said is are to uplift the pole money from the persones lyable therein conforme to the said extract, at the tyme and in the manner prescryved by the said act of parliament And for the discharge of the persones makeing payment the sub Collectors are to have ane other Roll or book bearing the title, Book or Roll of the poleable persones within such a Paroch who Have made payment of their respective polls set doune with the names in maner subjoyned which title being signed by the said two sub5 Commissioners and the persones makeing payment getting ther names or sums sett doune in the said Roll or book by the subcollector of of the paroch shall be to them a sufficient acquittance without the necessity of any discharge apart in case the party shall not requyre a Discharge and this book or roll containing the names and proportions of the Deficients, after the number of thretty dayes allowed to the persones lyable to come in and make payment, shall be given in with the money collected in every paroch to the Collector for supply of the Shyre who is immediatly to give to the subcollectors ane extract of the said Roll of payment for the paroch with his discharge at the foot thereof Registrat in the books of the Commissioners of Supply and ane extract of the same is to be returned and keept in the kirk sessione records of the paroch and the Collector of the shyre is further to insert the said Rolls after first being Compared by two of the Commissioners with the former Rolls in another book to be keept by the said Collectors and subscryved by the Commissioners of the Shyre or their quorum as the Register of payments of which second book or Register ane authentick double subscryved as above is also to be sent in to the Lords of the Thesaurie within fyfteen dayes after expyreing of the said thretty dayes and within the same space the foresaid Collectors of supply for the Shyres, are Hereby ordained to make payment to the Receiver generall of the Totall received by them for the paroches of every shyre for quhich they are to have the general Receivers Discharge to the shyre relative to the foresaid book and Register of payments brought in to the Thesaurie as said is and which discharge is to be registrat in the books of Exchequer and ane Extract therof given to the Collector of the Shyre to be carried back and keept in the Records of the Shyre and the foresaid Clerk and subcollector of the paroches for their whole paines in the premisses are to have allowance from the Commissioners of the Shyre out of ther Collectione not exceeding two per Cent of the money by them Collected and are hereby also declared to be punishable and fyneable for their neglect or fraud in the said Trusts by the Comissioners of the Shyres as they shall see see6 Cause Lykeas the said Collector of Supply for the shyre is for all his paines in the Haill premisses to have ane allowance from the Commissioners of the Shyres not exceeding two per Cent of the money payed in to him by the subcollectors and the said Collectors of Supply is lykewayes hereby declared to be punishable and fyneable by the Commissioners of the Shyre for their neglect and fraud as they shall see Cause and the foresaid Commissioners of the Shyres are Hereby commanded to attend and do their duety in the premisses in maner prescryved by the said act of parliament for pole money and by this proclamatione under the paine each of them of ten pounds scots toties quoties to be given to the Commissioners that doe meet and the Clerks of Supply for the severall shyres are Hereby ordained to send in Lists to the Clerks of our privy Councill of the Commissioners that doe not meet or keep the meetings either for the paroches or for the whole shyre within the space of fyfteen dayes after the elapseing of their respective dyets to the effect Letters may be direct against the said Commissioners failzieing to meet for payment of the said fynes And furder the said Commissioners in Case of their other neglects and failzieurs in the premisses as also the said Collectors of the shyres failzieing in their parts are Hereby declared punishable by our privy Councill as they shall see Cause And quhat is Hereby appoynted as to Commissioners of shyres within their bounds foresaid is also appoynted and injoyned to magistrats within burgh and ther subcollectors and under the same pains in all poynts with this express provisione That the subcollectors for Burghs give in their whole Lists to the Collector of supply of the shyre whereof they are a pairt to be by them registrat And to the effect the Commissioners of the shyre may inspect and see how the same are made and manadged And Lastly it is declared that the foresaid subcollectors and Collectors shall have power to exact the doubles and quadruples in the Cases foresaid The foresaid subcommissioners for paroches and Commissioners for shyres are Hereby impowered to decerne the persones failzieing and to direct executione against them in all poynts conforme to the act of parliament our will is herefore and we charge you Strictly and Command That incontinent thir our Letters seen ye pass to the marcat Cross of Edinburgh and to the marcat crosses of the Remanent head burghs of the severall shyres and Stueartries within this our ancient Kingdome and there by open proclamatione make intimatione Hereof That none may pretend ignorance and ordains these presents to be printed Given under our Signet at Edinburgh the tuenty seventh
