Act The heritors of Woodhouse
Anent the petitione given in to the Lords of his majesties privy Councill be James Deans of Woodhouslie and Alexander Bothwell of Glencorss Sir John Clerk of Peny Cook heritors of the paroch of Woodhouslie alias Glencorss for themselves and in name of their tenants Shewing That quher in obedience to ther majesties proclamation anent the Levieing of men for ther Majesties Service, The tenents of the said paroch did furnish ane man and keep him above four moneths at a daill of Charges against the mustering day Which was upon the twentie two day of May last in Burnsfeild Links near Edinburgh quher the said man was then delyvered to Robert Thomsone under Clerk of the shirefdome who gave ane recept of him to one of the fermers who came allongst with him which recept is in the Captains name and is wryten with the said Robert Thomsons oun hand as he does not deny, and that the man was truely delyvered to him, But so it is tha the recept is unsubscryved, and which was the Ignorance of the receiver to take it so But it could be proven be the said Robert Thomsone and many others that the man was truely delyvered and received off the tenants hands, and it is probable the man was put away amongst the detatched partie that was then sent to Flanders It was Therfore humbly conceaved that the petitioners hade done all the dilligence Requyred in obedience to ther Majesties proclamatione yet notwithstanding they are informed That they are fyned be the saids Lords for not giving obedience to the said proclamation in the soume of two hundred merks And Therfore Humbly Craveing the saids Lords would be pleased to take their case to Consideratione and to Discharge the said fyne since they did truely furnish the said man and keeped him above four moneths against the mustureing day upon their oun expences and gave him Eighty punds scots for his hyre and actually Delyvered him as the said receipt tho unsubscryved therwith produced would testifie and which they offered to prove if need were as the said petition bears Which being upon the fifth of February instant read in presence of the saids Lords They Remitted to the Committie appointed anent Souldiers and diserters to Consider and receive the petitioners probatione and in the mean tyme Discharged all executione against the petitioners for the fyne and not puting out the man Conforme to which referrence the Committie haveing mett and taken the depositiones of Sundrie famous witnesses, And The Lords of his Majesties privy Councill having this day Considered the saids depositiones They Find It Sufficiently proven that ther were thrie sufficient men delyvered for Sir John Clerk Woodhouslie and Glencorss and Received by Coll Douglas And Therfore They hereby Discharge the petitioners of any fyne alledged Imposed upon them for not furnishing of the man as in the petition And Declairs them free therof.
