Act and Recomendation, The Laird of Balhousie
The Lords of his Majesties privy Councill haveing Considered a report of a Committie of ther oun number appointed for reviseing the accompts resting by his majesties forces to the Countrey dated in anno Jaj vjc nyntie Bearing That Committie haveing Considered the accompts given in by the Laird of Balhousie with the depositiones of the apprysser taken before the Laird of Dun and the Comessar generall be vertue of ane act of Councill and warrand from Major Generall Mckay with the depositions of the parties taken before two Commissioners of assessment as to the rests due by the 2 officers and souldiers of the forces to them and of the Loss and damnage Sustained by the tennents throw the loss of ther Cornes They Find that in the particulars Imediatly aftermentioned Conforme to the depositions of the parties and the particular accompts therof is due by the Souldiers of the severall scots troops aftermentioned reckoning Eleven shillings Scots for furrage of the horss and meat to the horssman in the twentie four hours of ilk one of the troops of horss and nyne shilling scots a night to each dragoon horss and mans meat Ther is due the particular soumes underwritten Viz by the Earle of Eglingtounes troop the soume of ane hundreth and fourtein punds Eight shilling, By the Earle of Annandales troop the soume of twentie five pund threttein shilling Eight penies, By the Lord Beilhaven the Soume of Twentie five punds seventein the soume of Twentie five punds seventein shilling, By the Laird of Grubits troop five punds ten shilling By Captain Homes troop in the Lord Cardross regiment of Dragoons the Soume of ane Hundreth sixtie two punds six shilling all scots money And They Find by the regiments aftermentioned reckoning the soume of thrie shilling Scots a night for ilk Souldier ther is due the sums of money aftermentioned Viz By the Earle of Argylls regiment the sum of ane hundreth nyntie two punds sixtein shilling 3 the Lord Barganies regiment is two hundreth sixtie seven punds one shilling, By the Earle of Glencairnes regiment the soume of Threttein punds four shilling and by Captaine Bruces Company in the Castle of Blair Nyntein punds nyntein shilling all scots Extending in the haill to the sum of Eight hundreth twentie six punds fourtein shilling Eight penies Therfore the Committie are of oppinion that the saids Soumes due in maner forsaid should be retained of their pay, and that the generall receiver be ordained to make payment therof to the Laird of Balhousie And they haveing also examined the depositiones of the witnesses and appryssers as to the Loss and damnage of the cornes, They Find that ther has been distroyed by the forces the number of one thousand seven hundred sixtie eight bolls and ane firlot of Oats peese and bear with the Fother quherof ther is ane Hundreth and two bolls of oats pease and bear belonging to the Lord Aberuchills tenents Which at six punds scots the boll extends to the Soume of Ten Thousand six hundred and nyne punds ten shilling Scots, And they haveing Considered the Declaratione of the magistrats toune Clerk and quarter masters of Pearth Declaring the time the severall regiments were at that toune with the extracts of the routs ordered to and from the place under the hand of the secretary of Warr depute They Find that the Troopes under the Comand of the Earle of Eglingtoune The Lord Belhaven the Lord Rollo The Laird of Blairs troops the Laird of Polwarth and Sir William Hope came to Pearth the first day of August Jaj vjc Eightie nyne and stayed six dayes and that the Earle of Anandales troop was at that place the sixtein day of August and stayed till the fourth day of September by the space of nyntein dayes and that the Lord Beilhavens troop came then to that place and Continued ther dureing the said space and that the Laird of Grubitts troop came to Pearth the sixtein day of August and Contained ther for the space of nyntein dayes The Comittie reckoning them Conforme to the muster rolls and the seven officers servants as has been hitherto allowed, and Compting Eight shilling for the scots horsses They Find ther is due by the Earle of Anandale the soumes of five hundred and nyne punds Eight shillings By the Lord Beilhavens troope the like soume By the Lord Ross ane hundreth fourtie six punds and Eight shilling, By the Earle of Eglingtoune ane Hundreth thretie six punds sixtein shilling By the Lord Rollo ane hundreth and twelue punds sixtein shilling By the Laird of Blairs troop the like soume, By the Laird of Polwarth ane hundreth Fourtie six punds Eight shilling, By Sir William Hope ane hundreth threttie two punds and by the Laird of Grubitt Four Hundreth sixtie thrie punds twelue shilling being in the haill The soume of Two Thousand Two hundreth seventie punds two shilling Scots And Therfore the Comittie are of opinion that the Councill Recomend to the thesaury that they may give Order for retentione of the soumes of money abovewritten off the pay of the respective forces abovementioned and Give order for payment therof to the said Laird of Balhousie, and they Leave to the Councill to determine how the supperplus more then what payes the Laird of Balhousie shall be applyed And having Likewayes Considered ane other report of a Committie appointed to the effect forsaid dated the twentie seventh of February Last by past, Bearing That the Committie haveing Considered the accompts given in to them as resting be his majesties forces to […] Hay of Balhousie his tennents in the shyre of Pearth with the instructions and verificationes of these accompts They Find it suficiently verified and proven be the Oathes and depositiones of the saids tennants taken before the Commissioners of Supply within the Shyre of Pearth and produced to and Considered be the said Comittie That ther is resting by his Majesties forces upon scots pay to the saids tennents the soumes following Viz be the Garisone of Findlarig Comanded by Livd Rae the soume of Fourtie Eight punds nyne shilling scots money Item by the Garisone of Blair Comanded by Livd Walkingshaw the soume of ane hundreth and nyntein punds nyntein shilling scots money Item by the Earle of Glencairne his regiment of foot the Soume of fourscore Eight punds four shilling scots Item by the deceast Lord Angus his regiment of foot, The soume of ane hundreth and twentie six punds scots money forsaid Item by the deceast Lord Cardross his regiment of Dragoons the soume of seven punds Eleven shilling scots money forsaid item by the Lord under the hands of severall officers of the said regiment the soume of ane hundreth and thriescore one punds twelue shilling scots money forsaid Item by the forces followeing all upon Scots pay the soumes underwritten Which the Committie Finds suficiently instructed be the tenants oathes before the Commissioners produced and Considered as said is, Viz be the deceast Lord Angus his regiment of foot one punds ten shilling scots money forsaid Item by the said Garison of Blair the soume of seven punds sixtein shilling scots money forsaid Item by the deceast Lord Cardross his regiment of Dragoons the soume of Thrie score two punds twelue shilling scots, Item by the said Lord Elphingstoune his troop of horss the soume of five pund two shilling scots Item by the said Earle of Glencairne his regiment of foot the soume of seven pund ten shilling scots Item the said Garisone of Findlarig sixtein shilling scots Item by the Earle of Anandales troop of horss sixtein shilling scots Item by the said deceast Lord Bargeny his regiment of foott the soume of seven punds one shilling scots money forsaid Item by the deceast Earle of Mair his regiment of foot, the soume of five pund two shilling scots Extending the haill soumes forsaids resting to the saids tennents of Balhoussie by the forces forsaids upon scots pay to the soume of six hundreth and sixtie six punds fourtein shilling scots money forsaid, And the Committie Finds that the haill articles quherof this totall soume is made up are all for meath drink or furrage, and that they were all furnished preceiding the first day of February Jaj vjc nyntie one years, and that they are all in the termes of the nynth act fourth sessione of this Current parliament Intitulled act for polemoney and of the proclamations of Councill relative therto, And Therfore it is the Committies opinion that the said totall soume of six hundreth and sixtie six punds fourtein shilling scots money is to be payed to the saids tennents of Balhoussie out of the said polemoney And that they are to be Recomended to the saids Commissioners of his majesties thesaury for payment of the same accordingly, And the Committie Finds it suficiently instructed by the oathes and depositiones of the saids tennents taken before the Commissioners and produced as said is, That ther is resting by the forces following not upon scots pay to the saids tenants the soumes after specified viz by the Earle of Leven his regiment of foot the soume of Ten punds ten shilling scots money Item by Sir Thomas Livingstoune his regiment of Dragoons the soume of fourtie six punds Scots Item by Coll Ramsay his regiment of foot the soume of fourtie one punds seventein shilling scots Item by Coll Belvarage his regiment nyne shilling scots, Item by the English Regiment of horss the soume of five punds scots Extending the haill soumes forsaids resting be the saids forces not upon Scots pay to the soume of one hundreth and thrie punds sixtein shilling scots money And Finds that the haill articles quherof this totall soume is made up are for meat drink or furrage furnished preceiding the said first day of February Jaj vjc nyntie one years and are in the termes of the said act of parliament and proclamatione of Councill above narated, And Therfore its the Committies oppinion That Conforme to the said proclamatione thir soumes resting be the saids forces not upon scots pay are to be transmitted to his Royall majestie That he may order such Course to be taken therwith as in his royall wisdome he shall think fitt, And the Committie Finds it suficiently proven be the depositiones of the saids tennents taken and produced as said is, That his majesties forces under the Comand of Major Generall McKay when he returned frae Lochaber and encamped at Pearth and under the Comand of my Lord Drumlanrig in his march from Stirling to Pearth in the end of Jully Jaj vjc nyntie years Did eat and destroy the number of thrie hundreth and Eighty thrie bolls ane firlot ane peck of Corne with the Foder which at the rate of Eight pund per boll Corne and Fodder amounts to the soume of thrie thousand and thrie score score4 six punds ten shilling scots money forsaid all pertaineing to the saids tennents of Balhoussie and Finds by the rout of the forces at major generall Mckayes returne from Innerlochie in Jully Jaj vjc nyntie years subscryved by Sir George Hamilton of Binie extracted out of the secretary of Warrs books be John Crookshank, That the forces following did rest in and about the toune of Perth for the spaces aftermentioned Viz Sir Thomas Livingstoune his regiment of dragoons extending to thrie hundreth and sixtie horss reckoning sixtie horss in each troop the space of two Nights Item the Lord Newbotle the Master of Polwarth, The Laird of Grubitt and Laird of Pollock ther four troops reckoning sixtie hors in each troop the like space Item the Earle of Eglingtoune, The Lord Rollo, The Lord Beilhaven and major Samwell Stewarts troope reckoning the like number of Sixtie hors to each troop of thir four troops the space of five nights, and Reckoning Sir Thomas Livingstons Dragoons at nyne shilling per night for each horss and the rest of the troops being all upon scots pay at Eight shilling per night for each horss ther wil be resting by the saids Dragoons and other troopes forsaids the soumes following viz by the said Sir Thomas Livingstounes Dragoones The soume of thrie hundreth and twentie four punds scots money Item by the Saids Lord Newbotle Master of Polwarth Laird of Grubitt and Laird of Pollock their saids troops the soume of fourtie Eight punds for ilk one of their troops Inde for the wholl four the soume of ane Hundreth and nyntie two punds scots Item by the saids Earle of Eglingtoune Lord Rollo Lord Beilhaven and Major Samuell Stewart their four troopes the soume of ane hundreth and twentie punds scots for ilk one of ther saids troops Inde for the wholl four troops the soume of Four hundreth four score punds scots And it is the Comitties opinion that the soume resting be Sir Thomas Liveingstounes Dragoons is to be transmitted to the kings majestie that he may order such Course to be taken theranent as in his Royall Wisdome he shall think fitt, And that the soumes forsaid resting by the other troops abovenamed Which are upon scots pay Extending to the soume of six hundreth thrie score twelue punds scots money Is to be payed out of the present polemoney And that the saids tennents of Ballhousie are to be Recomended to the Lords Commissioners of his majesties thesaury for payment of the same accordingly, And the Committie Leaves to the Councill to determine how the rest of the pryce of the saids cornes not stated upon the above troopes is to be payed to the tenents forsaids, And the Committie finds it suficiently instructed by Coll Grahames order and Generall major mckayes Recomendatione to the Lords Commissioners of his majesties thesaury that ther was grassed in the Laird of Balhousie his park of Windiedge in Pearthshyre the number of ane hundreth and thrie score one horss for Carieing of bagadge for the space of Eight dayes in the moneth of Jully Jaj vjc and nyntie years Which at the rate of thrie shilling scots for each horss (being the rate in the major generalls order and which the major generalls order bears to be but the half of what is ordinarly giveing Extends to the soume of ane hundreth fourscore thretein punds four shilling scots money forsaid And the Committie Leaves to the Lords of his Majesties privy Councill how and in what maner this soume is to be payed to the said […] Hay of Ballhoussie and out of what fond and the Committie Finds that the haill soumes heirby Reported to be payed out of the present polemoney Extends to the soume of ane Thousand thrie hundreth and threttie eight punds fourtien shilling scots money, As the saids two severall Reports in themselves more fully bear The Saids Lords of his Majesties privy Councill Doe hereby Approve of both5 the saids Reports, And Recomends to the Lords Commissioners of his majesties thesaury To Cause payment be made out of the present poll money to the said Laird of Balhoussie and his tennents of all the Soumes, Which by either of the saids reports are reported to be payed out of the fonds either of the hearth money or polemoney and to transmitt the soumes reported resting by the forces not upon scots pay to the kings majestie that he may order such Course to be taken therwith as in his royall wisdome he shall think fitt And Restricts the Soumes resting for the baggage horsses mentioned in the second report from thrie shilling to two shilling scots per diem for each horss, and appoints this soume resting be the saids horsses when restricted as said is To be transmitted to the kings majestie that he may declare his pleasure theranent and what fond the same is the payed out off And Recomends to the saids Lords Commiesioners of his majesties thesaury To Cause payment be made to the said Laird of Ballhoussie and his tenants of the supperplus of the eaten and destroyed Cornes more then the soumes in the reports proportioned upon the particular forces who caled the same does extend to, and that out of the present polemoney Incaice ther shall be any part therof remaneing to the kings majestie after the accompts due to the Country and arreirs due to the armie are payed out of the same.
