Anent the Petition given in to the Lords of his Majesties privy Councill be Alexander Campbell Captain in the Lord Lornes regiment Shewing That wher being come over for recruits The petitioner seased upon one John Mulleon in Creiff in the Earle of Pearths bounds as a vagabound without observing the formality of takeing the shireffs Warrand, But haveing put him in Custody, So Soon as the petitioner understood that he should have had the shireffs warrand the petitioner dismissed him freely And then the man did freely take one with one Captain Meinzies in Coll Hills regiment as ane Certificat from the magistrats of Linlithgow lying in the Clerks hands would testifie, notwithstanding quherof and the petitioner truely dissmissed the man and he freely took on again as so is, yet it pleased the Lords of the Committie to Commit the petitioner prisoner untill he should produce him albeit it be manifast that the petitioner did abandon him and he disposed upon himself before any Citatione was given the petitioner And seing it appears hard that a Captain in his Majesties Service doeing all he can for recruites should be so sumarly Comitted and that the petitioner is Content to find suficient baill either to reproduce him betwixt and a Certaine day or at that day to re-enter himself in prisone And Therfore Humbly Craveing the saids Lords In Consideration of this his ingenious accompt and of the free and fair offer that the petitioner make, and that he humbly conceived that his majesties service is some way concerned in this affair to ordaine the petitioner to be sett at Liberty upon his said offer of Cautione as the petition bears, The Lords of his Majesties privy Councill, Having Considered this petition given in to them be the above Alexander Campbell They herby give Order and warrand to the magistrats of Edinburgh and keeper of ther Tolbooth to sett the petitioner at Libertie furth therof He first giveing bond and finding suficient Caution acted in the books of privy Councill That he shall produce the person of John Mulleon before the Committie of privy Councill appointed anent Souldiers and recruits betwixt and the fourth day of march nixt to come under the penalty of ane hundred punds sterling money.
