Liberatione Sir Æneas Mcphersone
Anent the petitione given in to the Lords of his majesties privy Councill by Sir Æneas McPhersone Prisoner in Edinburgh Tolbooth Shewing that where the petitioner having been seased […] Prisoner in February Jaj vjc nynty and four years by ordor of Sir John Trinhard upon suspitione of secret practises against the Government was in June following sent to Scotland aboard of one of his majesties ships of warr and Haveing arryved at Leith the tenth of August therafter was immediatly 2 ordered to this unheathy noysome jaille where the said petitioner hath been a Constant prisoner alwayes since and by his Long confynement contracted so many distempers and desease That ane incurable decay threatens if he is not shortlie set at liberty And therfore Humbly Craveing the said Lords to Commiserat the said petitioners Conditione and either to set him free or to allow Him for his health to be in some private lodgeing under guard with Libertie of the feilds the petitioner being content to inact himself under payne of death not offer his escape as the said petitione bears.
The Lords of his Majesties privy Councill Haveing considered the foresaid petitione given in to them by the said Sir Æneas Mcphersone They Hereby give ordor and warrand to the magistrats of Edinburgh and keeper of ther Tolbooth to set the said petitioner furth thereof In respect he hes inacted himself in the books of privy Councill That he shall Live peaceablie under and with all submissione to the present Government of his majestie King William and that He shall not Consult nor contryve any thing in prejudice thereof nor converse or Correspond with any Rebells and that He shall appear before the said Lords of privy Councill when called for under the penalty of ane Hundred pound Sterline and upon the said petitioners liberatione recalls the alliment allowed to him whyle he was a prisoner.
