Anent a Petitione given in to the Lords of his majesties privy Councill be Arthur Stratton sone and appearand air to umquhill Arthur Stratton of Whytlaw Shewing That quher the deceast Daniall Nicolsone wryter in Edinburgh pretended Creditor to the petitioners said deceast father and who upon that accompt hade apprysed and adjudged his wholl lands and estate Did by his letter of Concessione written ands subscryved with his hand of the date the thrid of november Jaj vjc nyntie thrie years For the Causses and Considerationes therin exprest Gave and granted his free and express Consent that Marion Straitton the petitioners mother should uplift and receive yearly from James and Robert Coutts and Jannet Drumond spouse to James Caldwalls present tennents in Drumdryden the soume of seventie punds twelue shilling scots money payable be them and to uplift the same from their successors tenents incase of removeall, And that for the petitioners mantinance and educatione at schoolls and otherwayes dureing the petitioners minority as the said concession and Consent of the date forsaid therwith produced in it self more fully bears, And seing that the same bears ane speciall provisione viz That the said aliement so granted should be allowed to the said Daniall in any proces of Compt and reckoning that should hapen to be raised against him Reserving his Objectiones against any Compt and reckoning allwayes as accords And that ther should be ane act of the saids Lords procured for his Warrand that the said aliement should be allowed as said is, Therfore and to the effect the2 forsaid mantinance and Grant therof might be made effectuall to the petitioner by purging the forsaid provisione And Therfore Humbly Craving the saids Lords would be graciously pleased by ther act to Ratifie the forsaid deed of Consent granted In favors of the petitioner In the termes of the said provisione for the warrand of the said umquhill Daniall his representatives and the poor petitioners aliement as the petition bears. The Lords of his Majesties privy Councill having Considered this petition given in to them be above Arthur Straitton and answers therto and haveing Considered the said petition and wrytes mentioned therin and produced therwith They hereby Ratifie and approve the forsaid decreet of Consent as to the petitioners aliement, And Declares that he said aliement shall be allowed to the said Daniall his Creditors or other representatives in any proces of Compt and reckoning that shall happen to be raised against them Reserving3 the4 objections against any such compt and reckoning as accords.
