Warrant
Warrand to receive Patrick Traill Cautioner for Patrick and James Feas
Anent a Petition given in to the Lords of his majesties privy Councill be Patrick and James Feas elder and younger of Whithall Shewing That quher the said Patrick having a proces depending before ther Lordships against Robert Elphingstone of Lapnes for spulzieing and awaytaking his wholl goods and estate He to Imped the petitioners prosecutione in the said action and knowing that as a stranger he would be straitned in finding Cautione upon the place He most maliciously and without all Imaginable ground Caused Charge the said Patrick Fea and the said James Fea his sone with Councill Laborowes and therupon has taken out Caption against the petitioners wherby they were necessitate to absent themselves and cannot appear to attend the prosecutione of ther action befor ther Lordships which is Lapnes only designe in raiseing therof albeit in obedience therunto they did offer Patrick Trai ventner burges of Leith Cautioner for the petitioners a man nottorly respected and the only freind and acquantance the suplicants hade upon the place yet he is wrongeously refused to be accepted without ther Lordships order And Therfore humbly Craving the saids Lords to Ordaine the Clerks either to accept of the Caution offered or to prorogate the dyet to such a Competent time as the supplicants send to Orkney and have Cautionrie returned by some of their freinds in that place as the petition bears The Lords of his majesties privy Councill Having Considered this petition given in to them be the above Patrick and James Faes They heirby Give order and warrand to the Clerks of Councill to receive the above Patrick Traill as Cautioner for the petitioners in the suspensione of Laborrowes offered at the instances against the above Robert Elphingston of Lapnes and therupon to exped and give out the said suspensione.
