Att Edinburgh The Tuenty sixth day of July Jaj vic nyntie four years

Decreet

Interloquitor The presbytrie of Stirling Against The magistrats therof

The which day the Earle of Linlithgow and Sir James Steuart their Majesties advocat Having reported verbally to the Lords of their majesties privie Councell That the process pursued at the instance of Mr George Turnbull moderator of the presbytrie of Stirling The Agent for the kirk and the members of the kirk session of Stirling uith Concourse of their Majesties advocat Against the provost three of the baillies and some of the toune Counsell of Stirling Is setled In these termes viz That Mr […] Buges be discharged to preach in the kirk called the uest kirk of the toune of Stirling and that noe meetings for preaching or divyne worship be keeped ther for heirafter except by order of Law and of the government And that the persons concerned proceed to Call a second minister according to Law and order now established and that both parties have assented to the aggreement and desyres that the saids Lords might Interpone their authority therto The saids Lords of their Majesties privie Councell Having Considered the above report and tearms of aggreement They heirby approve therof and Interpone their authority therto And appointes ane Act to be extracted in the terms of the same And Having farder reported that the other Lybell before the Councell at the instance of John Burd Late baillie of Stirling and others uith Concourse forsaid against the provost Baillies and Toune Counsell of Stirling Is also setled It uas moved that ther uere some articles of soe publict Concerne in that Lybell that a setlement betuixt privat parties Cannot take them auay but that their majesties Advocat should be ordained to Insist upon them And it Having gone to the vote whither their Majesties Advocat should instantly Insist on these points or if he should first precognosce the uitnesses It was Carryed procognosie And therfore the saids Lords Doe heirby Recommend to the said Lord Advocat to take precognition of the uitnesses which may adduced for proving these points And to report to them his opinione if the depositions uill amount to a probation And Recomends to the Lord Ross and Lord Poluarth to be present uith the Lord Advocat at the precognoscing of the uitnesses
