Anent the petitione given in to the Lords of their Majesties privie Counsell Be James Irvine macer Sheuing That the petitioner Having fallen into the misfortune in Letting yesterday Androw Baird escape out of the Committie room It is Humblie represented to his Grace and their Lordships That he Having at the present juncture three Gentlemen in custody And not knouing that any of them were In any worse Circumstance then ane other Ther Came Into the Committie room such ane Croud of poeple their Lordships sitting in Councell and George Weir the other macer Carrying Gairletoune to prisone that the said Andrew Baird made his escape For It is nottourly knouen that the petitioner hes been very valitudinary all this uinter being sick near unto death His Grace and the saids Lords knoues He did nevar fall into the lyke misfortune of before And therfore Humblie Craving his Grace and their Lordships to take the premisses to their consideratione and to sett the petitioner at Liberty as the said petitione bears Their Majesties High Commissioner and Lords of privie Counsell having Considered this petitione Given In to them Be the above James Irvine They heirby Give ordor and uarrand to the Magistrats of Edinburgh and Keeper of their tolbooth to sett the petitioner at Liberty furth therof And Have depryved and heirby depryves the said James off his office untill He produce and cause secure the persone of the said Androw Baird whom He suffered to escape by his negligence
